Testimony on HB 1080: Prohibiting PFAS in Condoms & Personal Lubricants I fully support HB 1080 for its intent to safeguard consumer health, particularly for vulnerable populations like women and LGBTQIA+ communities. However, the bill's effective implementation hinges on adequate oversight and funding, which are notably absent from its provisions. While it is commendable to ban harmful PFAS in intimate health products, without a dedicated budget for enforcement, there is a significant risk that this legislation will not translate into meaningful action. Indeterminable judicial and regulatory costs could leave the very communities this bill aims to protect without the necessary oversight they deserve. Moreover, the potential absence of a robust educational component about PFAS and its harmful effects further complicates the impact of this bill. While the ban is critical, it should be accompanied by outreach initiatives that inform consumers about their choices and the importance of safer products. Inclusivity in this information dissemination is essential, ensuring that marginalized groups receive targeted education that respects their unique needs and contexts. Lastly, we must recognize that public health should not be subject to uncertainty in enforcement. A well-funded and overseen initiative is vital to ensure that the benefits outlined in this bill are realized in practice. There is no place for ambiguity when it comes to the health and safety of our communities. We must advocate for comprehensive funding and programming that not only prohibits PFAS but also guarantees a safe, informed environment for all consumers.

PFAS pose a large concern to the public

Consistent with New Hampshire’s PFAS RESPONSES; New Hampshire has already established that: PFAS are harmful Intentionally added PFAS should be phased out where unnecessary Consumer products are a legitimate source of PFAS exposure This bill simply extends that logic to intimate health products, where the case for precaution is even stronger.
