This is a law long overdue. We have a militia, well regulated and it is the NH National Guard, so the whole 2A things is not valid for removing deadly weapons from a person of whom there is proof known to many beforehand, to prevent harm others or themselves. Enough deaths of victims by those who should not have deadly force in their possession. If NH leads on this, we save lives and most NH residents want it. Honorable Committee Members, I am writing to express my strong opposition to HB 1084 and urge you to vote Inexpedient to Legislate (ITL). While I recognize the seriousness of domestic violence, this bill raises significant constitutional concerns that warrant your careful consideration: • Second Amendment Rights: This legislation creates prior restraint on constitutional rights without adequate due process protections for law-abiding citizens. • Due Process Concerns: The bill may allow for the removal of firearms based on allegations alone, without sufficient safeguards to protect the rights of the accused. • Effectiveness Questions: There is little evidence that such measures effectively reduce domestic violence while they clearly infringe on constitutional rights. • Dangerous Precedent: This bill sets a concerning precedent that could lead to further erosions of Second Amendment rights in New Hampshire. New Hampshire has a strong tradition of protecting both public safety and constitutional rights. I was the victim of domestic violence where my partner had guns. In VT he was required to relinquish them immediately. Then I felt a little safer but then he wanted them back to be able to "hunt" and I was again, fearing for my life. He ultimately committed suicide ten years later but I was always looking over my shoulder. We need red flag laws and keep people safe.
