Testimony on HB 1464: Political Affiliation Discrimination I stand in opposition to HB 1464, despite its noble intent to protect individuals from politically motivated harassment and discrimination. While the bill addresses real and documented sources of trauma in our civic life, its underpinnings lack the necessary frameworks for equitable implementation, potentially reinforcing existing disparities in our criminal legal system. The complexities of political affiliation discrimination require careful considerations that this legislation does not adequately address. Moreover, without a clear focus on trauma-informed practices and oversight mechanisms, the enforcement of this bill risks perpetuating harm rather than alleviating it. The language used within the bill may unintentionally lead to criminalizing behaviors that are simply expressions of political dissent. This could disproportionately affect marginalized communities or those from minority political affiliations, further complicating their already precarious positions within public discourse. The lack of dedicated resources for training law enforcement and ensuring equitable application is a significant concern. Finally, any efforts to implement this bill must be rooted in an inclusive intersectional framework that recognizes the diverse realities faced by individuals based on their political beliefs. The risk lies in allowing a well-meaning law to become a tool for further marginalization rather than protection. It is essential that we refocus efforts to genuinely empower people affected by political discrimination while fostering an environment that promotes dialogue and understanding, rather than criminalization or division. We need to ensure that any protections afforded do not inadvertently isolate or vilify specific political voices.

This proposed bill does nothing to address the strife and division we currently see in our nation. This does nothing help anyone mend or come together. This bill will lead to further distress and disagreement amongst our citizens in the state.

This bill unnecessarily creates a new protected class based on political opinion, opening the door to abuse, frivolous claims, and chilled speech. Existing laws already address harassment and violence, and civil-rights statutes should not be politicized or used to shield people from criticism.

While I support the spirit of this bill, I am concerned that the current verbiage could be construed to protect people who have opinions against human rights or that acts of violence are appropriate. For example, if someone's political opinion is that republicans deserve to be interred at a work camp- protecting that kind of ideology is not appropriate leadership from the State and this bill is too broad.
