I oppose this bill. Distracted driving is a major cause of traffic incidents and accidents. We should not be reducing penalties for this.

Distracted driving keeps killing people. Keep this as a primary offense. Waiting until someone crashes or hurts someone to give a ticket isn't the right move.

Improper use of cell phones / mobile devices when driving is known to be highly distracting and the cause of many crashes resulting in serious injuries and fatalities. We need more enforcement of the current law which is a primary offense, not weaken it by having some other reason to stop a motorist before noting a cell phone was in use. Please help make our NH roads safer and not ignore distracted driving.

Dear Committee, I urge you to SUPPORT HB411 as this bill is just common sense. Please also refer to the REVERSAL of Case No. 2023-0345, State of New Hampshire v. Joseph Hoell, Jr., in which the New Hampshire Supreme Court reversed the trial court's decision because this individual was NOT using cell phone and was just holding it. This case alone, which went all the way to the New Hampshire Supreme Court, is enough to provide your SUPPORT for HB411. This is a bad bill. I've lost count of the number of idiots on phones who have almost run me off the road. They're worse than drunks and absolutely should be stopped and ticketed to the maximum extent possible.

With distracted driving becoming more and more the obvious cause of many vehicle accidents and injuries, we should not decrease the penalties for such behavior.
