It seems to me this law would put undue burden on the state and require state responsibility for constitutional rights violations that do not involve the state. This law burdens the state with unknown, thus unrestricted, damages.

HB 614 is an important piece of legislation that addresses past constitutional rights violations in New Hampshire. Currently under New Hampshire case law, one can receive a remedy in court if one's constitutional rights are going to be violated in the future or are currently being violated in an ongoing way. However, if any of your constitutional rights were violated in the past, and the violation is over, you cannot receive a remedy. In its proposed legislation, HB 614 seeks to fix this issue by asserting that if one's constitutional rights were violated in the past, one still has recourse to a remedy. This bill applies to every constitutional right, from the right to freedom of speech, to the right to bear arms, to the right to freedom of religion. I am an independent voter in NH. This bill seems to be unnecessary at best, and at worst creates an opportunity for frivolous lawsuits that tax our overburdened courts and increase costs for NH taxpayers.
This is good for state, but most abuse is of federal level rights.

HB-614 is remedial legislation to enable retroactive due process when constitutional rights have been violated in the past. Please vote OTP to fix this gap in the law to provide remedy to those who have had their rights so abridged in the past.
